A Superior Court judge has dismissed a lawsuit against Delaware for participating in a Regional Greenhouse Gas Initiative (RGGI).
The nine-state initiative started in 2008 and is meant to lower carbon emissions and fund renewable energy programs. It specifically limits carbon dioxide emissions from electric power plants and establishes a carbon dioxide allowance auction.
David Stevenson, Christian Hudson and John Moore sued the Delaware Department of Natural Resources and Environmental Control saying the RGGI caused their electric bills to go up.
Superior Court Judge Richard Stokes dismissed the suit last week after more than four years of litigation. He says the plaintiffs failed to demonstrate RGGI’s effect on their bills.
The nine states involved announced in August 2017 they would continue the program to decrease emissions through 2030, aiming to cut them by an additional 30 percent from 2021 to 2030.
