DelDOT sues to recoup I-495 repair costs

Delaware Public Media

DelDOT has filed a lawsuit against four companies it believes are responsible for nearly $45 million in damage to a section of the I-495 bridge in 2014.

After trying for two years to settle out of court DelDOT is suing Alma Properties, DuPont, Keogh Contracting and Port Contractors.

An agency investigation found 50,000 tons of dirt dumped near the base of a support pillar damaged the structure enough to misalign the bridge above.

The feds footed most of the emergency repair bill, with Delaware only responsible for $1.2 million.

Repairs spanned the entire summer, grinding traffic to a halt in Wilmington during weekday rush hours.

DelDOT says it remains open to an out-of-court settlement, but is prepared to take the matter to trial.
