Online fantasy sports games sidelined in First State

Online fantasy sports games where players can win money are no longer allowed in Delaware as of Thursday night.

The Delaware Department of Justice distributed a formal notice to several companies including Yahoo!, DraftKings Inc. and FanDuel Inc. saying under Delaware law, players are not allowed to win monetary prizes through online fantasy sports contests.

The state's Constitution generally prohibits gambling with the exception of lotteries under state control. State Department of Justice attorneys have determined fantasy sports contests are a form of gambling as they are governed by chance, not skill, and are not under state control.

The Attorney General's Office refrained from taking any action before now because lawmakers had been considering a legislation to address the issue, but no such bill passed before the General Assembly session ended last week.
